- Customer’s Privacy
- We respect our Customer’s privacy and will take reasonable measures to protect it, as more fully detailed below.
- Account registration and creation
- When a Customer registers with MyCafe and creates an Account on the website, information, including but not limited to the following, will need to be provided:
- Company & Trading Information – Company Name, Contact Details;
- Statutory Information – Company Registration, Tax Registration;
- Personal Information – User Name, Contact Details, Address etc.
- Account information changes
- Should the Customer’s company, personal or any other information change, the Customer will be required to inform MyCafe by updating the Account information in the My Account module, as soon as is reasonably possible.
- Cookies and caching terms
- This website makes use of “cookies” to automatically collect information and data through the standard operation of the Internet servers. “Cookies” are small text files a website can use (and which we may use) to recognise repeat users, facilitate the user’s ongoing access to and use of a website and allow a website to track usage behaviour and compile aggregate data that will allow the website operator to improve the functionality of the website and its content. The type of information collected by cookies is not used to personally identify a Customer. If the Customer does not want information collected through the use of cookies, there is a simple procedure in most browsers that allow a User/Customer to deny or accept the cookie feature. It is important to note that Cookies may be necessary to provide the Customer with certain features available on our website, and thus if disabled those features, as well as the Customer’s access to the website, will be limited. If the Customer does accept a “cookie”, it consents to our use of any information collected using that cookie subject to the provisions of paragraph 7.
- Account information
- The Customer may choose to provide additional information to MyCafe, in which event the Customer agrees to provide accurate and current information, and not to impersonate or misrepresent any person or entity or falsely state or otherwise misrepresent the Customer’s affiliation with anyone or anything.
- The purposes for which MyCafe will use the Customer’s information is as follows:
- in relation to the ordering, sale and delivery of items;
- to contact the Customer regarding current or new items (provided the Customer has not objected to receiving such marketing material);
- to inform the Customer of new features, special offers and promotional competitions (provided the Customer has not objected to receiving such marketing material); and
- to improve the Customer’s experience on MyCafe’s website by, inter alia, monitoring statistical non-personal browsing habits, and to transact with us.
- Customer information use
- MyCafe will not use the Customer’s information for any purpose, other than as stated in paragraph 6, without the Customer’s express consent. MyCafe will not use or disclose the Customer’s information to third parties without its consent unless the use or disclosure is:
- required in order to comply with applicable law, the order of a court or legal process served on MyCafe; and/or
- disclosure is necessary to protect and defend the rights or property of MyCafe.
- Disclosure of client information
- MyCafe will be entitled to disclose the Customer’s information to those of our employees and/or third party service providers who assist MyCafe to interact with the Customer via our website or email, for the ordering of items or when delivering orders, and thus requires Customer information in order to assist MyCafe in communicating with the Customer properly and efficiently. MyCafe will to its best effort ensure that all such employees and/or third party service providers having access to the Customer’s information are bound by appropriate and legally binding confidentiality and non-use obligations in relation to the Customer’s information.
- MyCafe’s obligation
- treat Customer information as strictly confidential;
- take appropriate technical and organisational measures to ensure that the Customer’s information is kept secure and is protected against unauthorised or unlawful processing, accidental loss, destruction or damage, alteration, disclosure or access;
- provide the Customer with access to its information for the purpose of viewing and/or updating personal details;
- promptly notify the Customer if we become aware of any unauthorised use, disclosure or processing of the Customer’s information;
- provide the Customer with reasonable evidence of our compliance with our obligations under this policy on reasonable notice and request;
- upon the Customer’s request, promptly return or destroy any and all of its information in our possession or control; and
- not retain the Customer’s information longer than the period for which it was originally needed unless required by law to do so.
- Customer information and third-party use
- MyCafe undertakes never to sell or make the Customer’s information available to any third party unless we are compelled to do so by law or operational requirements. In particular, in the event of a fraudulent online payment, MyCafe reserves the right to disclose all the relevant information for criminal investigation purposes or in line with any other legal obligation for disclosure of the information which may be required of it.
- Limitation of liability
- Whilst MyCafe will do all things reasonably necessary to protect the Customer’s rights of privacy, MyCafe cannot guarantee or accept any liability whatsoever for unauthorised or unlawful disclosures of the Customer’s information, whilst in our possession, made by third parties who are not subject to our control, unless such disclosure is as a result of MyCafe’s gross negligence.
